When filing a lawsuit in Los Angeles against an at-fault driver for any auto accident you have been involved in, there are a series of steps which must be completed before the filing of the lawsuit is considered successful.  One of these steps is called service of process.  Service of process is a formal procedure which makes the at-fault driver or opposing party aware that he or she is being sued by you, the Plaintiff.  When process is “served” on an intended party, two documents are involved- a summons and a complaint.  The complaint lays out the basis for the lawsuit- the facts according to the Plaintiff, why the at fault driver is being sued, and what the Plaintiff wants from the at fault driver.  The summons portion formally states that the at fault driver is being sued, a court date for the hearing, and a notice that the Defendant now has 30 days to respond to the complaint.

The summons and complaint is a very formal proceeding with specific requirements as to how the at fault driver receives the documents.  In Los Angeles, a potential Defendant can be served with process in four primary ways.  A sheriff or even a Marshall can be used to deliver the documents personally; a process server with an appropriate license can be commissioned to personally deliver the documents; through certified mail per a court clerk; and, in some cases, through “substituted service.”  Substituted service will allow, in very limited instances, service of process to be conducted on someone besides the at fault driver or Defendant to be.
